Why You Should Fight Your DUI

Have you been charged with a DUI? Do you assume you will be found guilty? Do you think there is nothing you can do? Well, you are wrong, because being charged with DUI does not mean you have been convicted of DUI; the government still has to prove its case against you.

There are two big reasons why you should fight your DUI.dui

Police Make Mistakes

Seemingly "airtight" DUI cases can and do fall apart. Here are three ways it can happen:

  • The driver without reasonable suspicion or probable cause
  • The police officer violated the U.S. and/or Pennsylvania Constitution

I have been practicing law for more than 40 years. I served as a Chester County prosecutor for 14 years; during four of those years I was Chester County's first full-time district attorney and have done thousands of driving under the influence cases. I know how to find police mistakes in DUI cases and I know how to protect your rights.

You Do Not Want A Second DUI

In Pennsylvania, an individual can be charged with drunk driving when the driver's blood-alcohol content reaches .08. Penalties will include: license suspension of up to 12 months; jail time up to six months; and fines up to $5,000.

Those penalties are bad enough. However, it is critical to keep a clean driving record and not get that first DUI on your record because the penalties in Pennsylvania for a second DUI conviction can be even worse:

  • Up to 5 years in jail
  • Suspension of your driver's license for up to 18 months
  • Fine of up to $5,000
  • Ignition interlock for up to one year

You absolutely do not want two DUI convictions. The best way to avoid a second DUI is not drink alcohol at all and don't use prescription medication excessively or unlawful drugs at all and drive.
